摘要
对水权产生的背景进行了回顾,参照我国水权理论的法律基础,对水权的概念进行了解读,对水权所包括的水资源的所有权和使用权进行了研究。在此基础上,对如何完善我国水权制度框架提出建议,包括理顺水权概念和体系、加强水法的立法工作、引入第三方机构等。
The background of water right was reviewed, by reterring to legal basis oi water right theory m China, the concept ot water right was interpreted. The ownership and use of water resources was studied. On the basis of this, several suggestions for perfecting water right institutional framework system in China were put forward, including the water right concept and system should be straightened out, water legislation work should be strengthened, the third parties should be introduced to regulate the circulation of water resources.
