摘要
水是人类生存的生命线 ,是经济发展和社会进步的生命线 ,是实现可持续发展的重要物质基础 ,具有不可替代的作用。水权是依法对于地面水和地下水取得使用或收益的权利 ,水资源所有权为水权之母 ,水权是水资源所有权的派生物 。
Water is the lifeline that the mankind survives, and the lifelines of the economic development and social progress.It is the important material base of realizing sustainable development,and has irreplaceable function . This article begins with the meaning of “water rights”; Think that water right is to make the right which uses the income to the surface water and groundwater in accordance with the law, the ownership of water resource is a mother of water right,then the article defines the water rights as a kind of new-type benefial right in the civil law.
