摘要
农民工为我国城市化进程和经济发展做出了突出贡献,然而,目前我国农民工在工伤维权方面仍面临很多困难,如大量农民工还与工伤保险无缘,无法享受工伤保障基金;依法索赔得不偿失。这些都反映了我国现存的农民工工伤维权机制还存在诸多不完善之处,需要努力加以改进。从行政方面、法律制度方面、用人单位方面、农民工自身方面出发,多管齐下,并且多从农民工维权的实际出发,遵循便民、照顾弱势群体原则改进现存的维权机制,对于减少社会矛盾,转变政府执政理念、加快职能转变,完善相关法律法规、加大执法力度,都具有重要意义。
Peasant workers have made outstanding contributions to Chinese process of urbaniza- tion and economic development. However, at present, peasant workers in China is difficult to maintain rights on occupational injury, for example, a large number of peasant workers have no occupational injury insurance, can not enjoy the work injury insurance fund; cannot get the legal compensation. M1 these reflect that the existing peasant workers＇injury protection mechanism in our country still exist many imperfections, need to improve it. We start from the perspective of administrative, legal system, employing unit, peasant workers themselves, cooperating with each other, from the real situation of the rights of peasant workers, following the principles of being convenient to peasant workers, caring for the vulnerable group, in order to improve the existing mechanisms of maintaining their rights, it is of great significance to reduce social conflicts, to change the government political philosophy, to speed up the transformation of government func- tions, improve the relevant laws and regulations and strengthen law enforcement.
