摘要
作者有就他人使用作品的行为收取报酬的权利。使用作品付酬标准不明,既不利于著作权人合法权益之维护,又影响作品使用者的使用。故应在相关法律中明确作者就他人使用作品行为获得合理报酬之权利,增加作者查询作品使用收益账目权。同时完善相关使用作品付酬标准条例,提高法定付酬标准,修改法定付酬计算方式。
The copyright owner is entitled to receive payment by licensing the others to use his works.The illegible use will not only damage the interests of the author but also interfere with the normal use of the author＇s works by the license,so the Copyright Law should define the terms and rates of royalty payments to increase the author＇s right of inquiry and simultaneously improve related regulations to improve terms and rates of royalty payments,arise the statutory fee and modify the calculation.
