摘要
判断信赖原则如何具体地在垂直型组织医疗体系中得以适用,这是困扰刑法理论及其实务的一道难题。医师对医疗协助人员遴选、监督、任务交付中的信赖原则适用判断,即对医师与病人、受过培训或者未受过培训的辅助人员之间适用信赖原则的情况予以分析。结合涉医刑事司法实践,进一步相关医疗行为之客观注意义务的范畴,明确具体情况中客观归责之判断与信赖原则之适用的角力空间。
It is determined, how the principle of reliance specifically in medical system can be used in vertical organization, what is a difficult problem in criminal law theory and practice. The situation is analyzed, that the doctor must choose and supervise seriously the persons, such as nurses, patients and other inexperienced persons, that help the doctor finish the medical behavior, here focuses on whether the principle of before he can give the persons jobs. It reliance can apply in the situation. Combined with the German medical criminal judicial practice, it further pays attention to the obliga the demarcation line tlons betw in the medical behaviors.
