摘要
应否设立居住权,我国《物权法》颁布前后,学界争论不断。由于物权立法未确立物权性居住权,单纯依靠债权制度难以对居住权人提供充分的保护。司法实务中,由于缺乏相应法律规定,导致法官裁判往往偏离物债二分立场,突破现有法律规定,赋予居住权以物权性和物权效力。要解决当前社会对居住权需求这一普遍性社会问题、对居住权的保护要求作出物权法回应,关键在于完善居住权立法,设立物权性居住权,建立完善的居住权体系。
Before and after the promulgation of Property Law,the academia have been arguing whether to establish the right of habitation.Since the right of habitation with property right is not established in the legislation of property right,it is difficult to protect the holder's right of habitation adequately only by system of claims.In judicial practice,due to the lack of relevant legal rules,judges'judgments often deviate from the position of dualistic structure of property,break existing legal provisions and regulations,giving the right of habitation a property right and property effects.To solve the general social problem of current society's demand of the right of habitation and give a response of property right to the demand of the protection of the right of habitation,the key is to complete the legislation of residential right,establish the right of habitation with property right and build a perfect system of the right of habitation.
