摘要
立案登记制度既为民众开辟了更为有效的通过诉讼寻求纠纷解决的道路,同时也为恶意诉讼打开了方便之门。恶意诉讼防治首先应当知悉恶意诉讼的多样性特征,协调立案登记制度在应对恶意串通的虚假诉讼和妨碍逃避执行中的作用,为司法改革寻找适合的协调适用方式。警惕立案登记制度适用时可能存在的案件信息泄露风险,并就可能出现的信息泄露主体予以明确,通过对相关法律规定的探索寻求责任承担方式。
To protect litigants＇ right of action and make civil litigation more convenient and more ti^macy to all the parties, the case filing registration system has been put into effect. The coming of ac- creditation by registration not only blazes a more efficient trail for the masses to settle dispute through litigation, but opens up a convenient door to malicious civil litigation as well. For the relationship be- tween the prevention of malicious civil litigation and the accreditation by registration, we should first know diverse characteristics of malicious civil litigation and the function of registration system in dealing with malicious collusive false litigation and escaping execution, so as to seek a coordinated applicable method for judicial reform. We should also keep a wary eye on potential risk of case infor- mation disclosure when applying the case filing registration system, clear about the potential subjects of information disclosure, and look for a way to take responsibilities by exploring relevant legal provi-sions.
