摘要
关于少数民族环境习惯法的时代价值,现代视野多集中于法学价值挖掘。就民族环境习惯法本身而言,其在民族场景下的角色并不仅仅是生态环境规则,因此,对环境习惯法价值的深层次全方位挖掘必须基于其在民族场景中的真实面貌和角色来进行。根据环境习惯法在民族社会中的功能、表现和影响,认为民族场景中的环境习惯法客观上充当了民族社会秩序规范、地方性知识载体、信仰表现形式、行为模式依据等角色。
As for the value of minority customary environment law, modem people are primarily focused on the law value. In fact, they are not just the ecological environment rules based on the minority scenes, therefore, the exploration of the environmental law must be placed into the authentic minority scenes. According to the function, performance and the influence of the environmental law, argues that the minority customary environment law in the minority scenes can function as the minority social norms, local knowledge carrier, beliefs, and behavior model.
