摘要
中国量刑规范化自列为重大司法改革项目后,在期待与质疑中推进了十年。期间经过了从过去"部分法院初步试点-全国法院全面试点-全国法院全面试行"到当前"全国法院全面施行"的发展历程。理性检讨这十年的探索实践,其既取得了将量刑纳入庭审程序、全面提取和适用量刑情节、真正改变"轻量刑"观念等革命性成就,也存在实体规则的设置违背刑法基本原理、理论依据的借鉴存在致命误区、意见规则的适用与法典法律适用相冲突、程序规则的设置不能与实体法对接等僵局性问题。展望未来,量刑规范化的规则设置及其实践运行,需坚守刑法及其法律适用的基本原理和量刑的基本运行规律,变量刑运行中的精确数量化为模糊裁量。
Since being listed as the important Judicial Reform Project, Chinese standardization of sentencing has been conducting in anticipation and query for ten years. During the ten - year period, the standardization of sentencing has slipped from the past "the initial pilot of the part courts - comprehensive pilot of the national courts - full trial of the national courts" to the present "full implementation of the national courts". After making a rational review of the exploration of ten years, it can be found that the standardization of sentencing has achieved revolutionary achievements, including bringing the sentencing into the trial procedure, completely extracting and applying the circumstances of sentencing and really changing the concept of contempt of sentencing. On the other hand, there are also some rigid problems in the standardization of sentencing, including substantive rules violating the principle of criminal law, rationale having some fatal misunderstanding, application of the rules of standardization sentencing running counter to the application of code of law and procedural rules being inconsistent with substantive law. Looking to the future, the setting of rules and practice operation of the standardization of sentencing should stick to the basic principle of criminal law and application of the criminal law and the basic operation rules of sentencing, and change the precision quantification to the fuzzy discretion in the operation of sentencing.
