摘要
我国处于构建"大调解"格局的主流发展趋势,探索民间劳动争议调解组织的实践经验是发展多元化调解机制中的大胆尝试和创新。民间劳动争议调解组织在调处工作中的灵活度和搭建信任都独具特色,独立第三方介入的方式在某种程度上能使争议双方快速放下戒备心理更易于达成协议。民间劳动争议调解组织的生根和发展路径研究将对加强和完善我国劳动争议调解机制大有裨益。本文将从调解理念、实践条件、特色机制、调解效果、发展方向等五个方面介绍和分析一例民间的劳动争议调解组织。
The main trend of our country currently is to build a "big intermediation" pattern. Discovering the practical experiences of civilian labor dispute mediation organizations is the bold experimentation and innovation during the development of pluralistic intermediation mechanism. The civilian labor dispute intermediation organizations have flexibility as their character and built trust during mediations. To some extent, the intervention of independent third party can make both parties to let their defenses down and reach an agreement quickly. The research of the rooting and development path of civilian labor dispute intermediation organizations will be of great advantages to strengthen and improve the labor dispute intermediation mechanism. This paper introduces and analyzes a civilian labor dispute intermediation organization in five aspects: concept of intermediation; practical conditions; characteristic mechanism; effect of intermediation; development direction.
