摘要
传统理论研究"土地法",而近些年来,随着对城市地下空间利用的深入,各国开始探讨"空间法"。对城市地下空间权利性质的研究,我国学者有不同观点,典型的有"空间利用权说"、"空间基地使用权说"、"空间所有权说"。应该说,城市地下空间所有权具有独立性,是一项独立于土地所有权之外、与土地所有权相关的不动产物权。
The traditional theory researched "land laws" , in recent years, with the deepening of urban underground space utilization, countries began to explore the "space law". Chinese scholars have different views on the research of urban underground space right nature, for typical examples," right to use space", " right to use the space base"," space ownership". It should be said that the ownership of the urban underground space is independent. And it is a real property rights, which is unlike the land ownership but associated with land ownership.
