摘要
《1 978年美国印第安人宗教自由法》的制定和颁行,对美国印第安人争取和维护自身宗教信仰及其自由实践具有里程碑式的意义。美国印第安人利用这部法律诉诸司法实践积极为自身争取宗教自由权利,这一过程生动而鲜明地彰显了信仰与理性在当代美国社会场景下的冲突和对话,从而丰富和深化对作为美国历史文化关系中的一个重大问题——印、白关系史的理解,美国文化群体应当逐渐走出"两极"对立的思维模式而趋向从印、白文化关系的相互观照中理解和把握共同生活栖居的文化世界,使美国文化群体的思维方式真正实现从"两极"对立与排斥到"多元"包容与合作。
The enactment of the American Indian Religious Freedom Act of 1978 had a monumental significance for American Indians to preserve and protect the religious cultural rights and practices. American Indians resorted to judicial practice for the preservation and protection of their religious freedom, which was proved the polarization and accommodation between faith and ration come into prominence in contemporary U.S. How to understand and coordinate the conflict between the American jurisprudence and American Indian religion need the transcendence of reflection and transformation of thinking for the U.S. society. The formation of intermediary way of addressing the conflict need the long-standing historical complexities and contradictions entangled in the white-indian relationships.
