摘要
当前，以涉“孝”纠纷为典型，传统伦理通过运用于现代司法之中，悄然地在现代法治社会中重获新生。但传统伦理与现代司法的融合并非易事，传统伦理拥有着自身的理念和内在逻辑。传统伦理与现代司法之间既存在着内在的张力，成为两者融合的障碍，同时它们也有着契合点，有助于两者融合形成合力。通过对中国传统伦理在现代司法中的运用进行逻辑分析与梳理，有助于为中国传统伦理与现代司法乃至现代法治的结合提供理论支持，对推进当下“法治中国”的发展建设有所裨益。
Currently, in order to involve ＂ filial piety＂ dispute as a typical, traditional ethics is through the use of modern justice, quietly reborn in modern so- ciety ruled by law. But the integration of traditional and modern judicial ethics is not easy, traditional ethics ownerg own philosophy and inherent logic. Between the traditional and the modern judicial ethics both intrinsic tension, become an obsta- cle to the integration of the two, but also has a meeting point of convergence, will help both integration efforts. Analysising and combing logically of Chinese Tradi- tional Ethics＇ application in Modern justice helps to provide theoretical support for the combination of Chinese traditional ethics and modern justice even the modern legal govern . Also benefits for the development and construction of promoting cur- rent ＂rule of law in China＂.
