摘要
预防原则肇始于工业时代风险预防的逻辑"悖论",在"人命关天"隐忧下,逐步演变为食品安全法中的一项基本原则。预防原则启动的前提条件是科学不确定性,在具体的适用过程中还应遵循成本效益原则、比例原则和同等对待原则。基于预防原则而采行的预防措施还必须进行持续的审查和定期的考核,以因应科技的变迁。
The precautionary principle originated from the industrial age risk prevention logic'paradox',in the 'human life'worry,gradually evolving into a basic principle of the law of food safety.A precondition for preventing principle start is scientific uncertainty; in the specific application,process should follow the cost- benefit principle,proportion principle and equal treatment principle.Based on the principle of prevention,preventive measures must be taken to review and regular assessment,for the progress of science and technology.
