摘要
市场必须在土地资源配置中起决定性作用,政府要尊重市场规律和土地产权主体的利益,通过制定科学合理的规划和平等的用途管制政策更好地发挥辅助作用。在土地制度中,之所以规定任何单位搞建设必须申请使用国有建设用地,集体土地只有通过征收为国有建设用地才能出让,根本原因在于宪法中存在着城市土地国有制和公益性征地原则的二律背反。针对农村集体经营性用地问题,应适时调整农村集体建设用地结构,实现经营性建设用地动态管理,使土地资源合理有效配置。要建立进城落户农民宅基地有偿退出机制,对于符合享受公租房条件的农民工,不能强迫无偿放弃原宅基地使用权。建议改变以往城乡建设用地增减挂钩的方式,按照城乡建设用地市场一体化的构想,允许农村集体建设用地指标在农民(集体)之间流转。另外,现行的土地管理法明显存在着对农村集体土地所有权的歧视,相关条款应修改。
The market must be decisive role in the allocation of land resources, the government should respect the market rule and interests of the land property right subject by formulating scientific and rational planning and equal use control policy and play a supporting role better. In land system, the stipulation of any unit must apply to use the state-owned land for construction purposes, collective land only transferred by taxing for state-owned construction land, the fundamental reason lies in the antinomy of principles between the state ownership of urban land and the commonweal land expropriation in the constitution. In the light of problems of the rural collective land use, we should timely adjust the structure of rural collective construction land, realize the dynamic management of operational construction land, reasonably and effectively configure the land resource. We should build the paid exit mechanism of the house site owned by peasants going into town and settled in the city, to migrant workers conforming to public housing conditions, cannot be forced to abandon the original land use right gratis. We should according to the idea of integration of urban and rural construction land market, allow the rural collective construction land index transfer among farmers (collective). In addition, the current land management law existed obvious discrimination against rural collective land ownership, the terms should be modified.
