食品安全刑法规制的现状与完善

摘要 食品安全犯罪案件频发,给国家和广大民众造成巨大损失,社会影响极大。面对严峻的食品安全形势,国家高度重视,颁布《食品安全法》并将风险刑法观引进刑法,降低入罪的门槛,扩大惩处范围,加大惩罚的力度。但食品安全案件却屡屡爆发,并没有得到根本解决。本文通过分析食品安全刑法规制的现状,指出现行刑法规制存在的问题进而提出完善的建议,以期实现有效惩罚与震慑食品安全犯罪的功效。 In these years, more and more food safety crimes happened frequently, which caused huge losses of the state and the general public. Confronting a serious food security situation, the state realizes the great importance to the promulgation of the "Food Safety Law" and the concept of the Criminal Code of Criminal Law. The paper suggests that we should reduce the threshold of incrimination, expand the range of punishment, and increase the intensity of punishment by implementing the law. By analyzing the present condition of criminal regulation of food safety and the regulation execution problems, the paper did make practieal recommendations to achieve an effective punishment and deterrent effectiveness of food safety crimes.
