摘要
从构成要件和违法性的关系看,构成要件理论分为行为类型说、违法类型说和违法有责类型说,而构成要件的机能一般认为分为罪刑法定主义机能、犯罪个别化机能、违法推定机能和故意规制机能。三种构成要件类型在实现构成要件的四种机能上发挥着不同的影响,因此,构成要件类型的定位对构成要件机能的理解和重视有着密不可分的关系。
From the relationship between the constitutive elements of crime and the rechtswidrigkeit, the reehtswidrigkeit theory includes types of behavior theory, rechtswidrigkeit theory and rechtswidrigkeit and responsibility theory. The function of the constitutive element are generally divided into four types, including legally prescribed punish- ment function, crime individualized function, the rechtswidrigkeit presumption function and regulatory function to the in- tentional unlawful actions. Each constituent element type plays different effects in the way to realize the said four functions of the constitutive elements of crime. Therefore, the element type of crime has a close relationship with the understanding of the functions of the constitutive elements of crime.
