南通大调解:非诉讼纠纷解决的制度化探索 被引量:5

摘要 当前我国正处于社会转型时期,社会矛盾纷繁复杂,而利益是引起一切社会矛盾的根源。当前,矛盾的主体呈现出多元化的趋势,因此非诉讼纠纷解决不能依靠单一的力量。南通大调解在解决社会矛盾的过程中,整合各种资源,综合运用多种手段:政府是连接矛盾主体与调处中心的桥梁与纽带,社会各种资源在矛盾解决中也起了重要的作用,而矛盾的主体,即当事人,从"影响者"到"参与者"再到"共同治理者"的转变则充分证明了其在大调解中的地位。由此可见,南通大调解正向着制度化的方向发展并且不断完善。 As our country is in the social transformation period , the social contradictions are extraordinarily complicated at the present , the deep cause of which is the conflicts of interests. Then the alternative dispute resolution can not only depend on a single power. For example, the Nantong multipartite mediation pattern conforms to kinds of mediation resourses and uses diverse methods to solve social disputes effectively. During this process, the government is the bridge and the link relating the disputers to the mediation centre, meanwhile, the various social resourses play a crucialrole, and the persons involved turns from the influencer to the participator even to the co-governancer, which proves they also are very significant in this process. Thus it can be seen that the multipartite mediation is developing towards the direction of institutionalization and continuous improvement.
