摘要
2014年5月1日生效的《商标法》和正在修订的《反不正当竞争法》从立法层面,对商业标识的保护做了一些新的规定:首次确立了商业标识的概念;扩大了商业标识的保护范围,加大对在先使用的未注册商标的保护力度,增加和细化了商业标识不正当竞争行为的类型,对假冒商业标识的不正当竞争行为的规制从使用延伸至生产经营等其他环节;注重对商业标识权利冲突的立法协调,对商业标识反向假冒行为的双法规制。两部立法保护的对象虽各有侧重,但共同关注对商业标识使用的界定,在判断商标侵权和构成不正当竞争行为的认定标准上有其共性。两部法律相互补充,力图协调解决商业标识之间的权利冲突,呈现出立法体系化之美。
May 1,2014 entry into force of the “trademark law”and the ongoing revision of the “Anti Unfair Competition Law”made some new provisions for the protection of commercial marks.First the concept of commercial mark was established;the protection scope of business identification was expanded,and increased was the protection of the prior use unregistered trademarks,refinement regulation type,commercial mark acts of unfair competition acts of unfair competition of fake commercial marks from the use of extended to the production and management and other aspects;attention was paid to the coordination of commercial mark rights conflict.Double law regulation of commercial identifies the reverse counterfeits behavior.Two Departments of legislation to protect the object are different,but the common concern for defining commercial logo has its generality in the judgment of trademark infringement and unfair competition behavior cognizance standard.The two laws complement each other,trying to solve the conflict between the right of commercial mark legislation system.
