摘要
刑事错案并不完全等同于平时所说的冤假错案,其主要包括因客观原因而产生的错案,以及因为主观上存在司法过错而产生的错案。对于前一种情况无法完全避免,但可以通过专业水平的提高及侦查技术等的进步来减少;对后一种情况则可以从多种层面予以遏制,进而完全避免出现人为因素导致的刑事错案,树立司法权威。检察机关作为国家的法律监督机关,在刑事诉讼中应当及时、准确地查明犯罪事实,追究犯罪,保障无罪的人不受刑事追究,通过多种途径克减刑事错案的发生。
The criminal wrong cases are not exactly the same as the usual miscarriages of justice, which mainly includes the wrong cases due to objective reasons, as well as subjective judicial faults. For the former reasons, it can not be completely avoided, but can be reduced by raising the level of professional advancement and investigative techniques; For the latter reasons, it can be contained from a variety of levels and completely avoided wrong cases caused by man-made factors to establish a judicial authority. As a national legal supervisory authority, the procuratorial organ should timely and accurately identify criminal facts,investigate the crime and protect innocent people from criminal prosecution in criminal proceedings, and derogate criminal wrong cases occurred through a variety of ways.
