摘要
能源安全的内涵应包含供应安全和生态安全两层涵义,能源法呈现生态化趋势。我国现行的能源法在生态安全保障上仍然存在很大的不足,例如能源生态安全理念不够深入,能源立法体系不够完善,能源法律制度亟需健全和创新等。在能源法的生态化变革中,要将生态安全作为能源立法的重要价值目标,对能源法体系进行全面的生态化构建,加强能源法与环境法的融合,重视新能源的污染问题,并将外部性解决作为构建生态能源法律制度的基本思路。
The connotation of energy security should include the supply security and ecological security of two layers of meaning, showing the ecological tendency of energy law. However, there are many problems in the ecological security of our current energy law. Such as the concept of energy ecological security is not deep e-nough, energy legislation system is not perfect and energy legal system needs to be perfected and innovated. The ecological reform of energy law should focus on the establishing the value of ecological security objectives, concerning the ecological construction of energy law system, strengthening the fusion of energy law and environ-mental law and paying attention to the problem of pollution of new energy. In addition, external solution should be the basic idea of constructing ecological energy legal system.
