摘要
专利纠纷行政调解协议司法确认制度是一种新的专利纠纷解决机制,它承接了专利行政保护和司法保护两者的优势,符合当前"大调解"解决纠纷、营造和谐社会的发展需求。一种法律制度其程序构造的好坏,直接影响这一制度的好坏,建立完善规范的专利纠纷行政调解协议司法确认程序,是发挥这一制度优势的前提。本文通过探讨专利纠纷行政调解程序和司法确认的相关问题,尝试提出符合当下需求的专利纠纷行政调解协议司法确认程序。
Judicial affirmation system of administrative mediation agreement of patent dispute is a new approach for resolution of patent dispute, which combines the advantages of administrative protection and judicial protection of patent. It meets the requirements of the concept of＂grand mediation＂ and the development of harmonious society. The construction of legal system depends its advantage, thereof the construction of judicial affirmation system of administrative mediation agreement of patent dispute is the prerequisite of its implementation. This article tries to analyze relevant problems and countermeasures of judicial affirmation system of administrative mediation agreement of patent dispute.
