摘要
党的十九届三中全会对深化党和国家机构改革进行了全面部署,当前我国知识产权综合管理改革的理论支撑、政策条件、实践经验已经成熟,深化湖南省知识产权综合管理改革势在必行。在深化机构改革的宏观背景下,湖南省知识产权工作还存在申请数量增高与有效率低之间、案件超高速增长与执法人员减少之间、职责增重与职能减弱人员减少之间三大突出矛盾。对此,可以从五个方面加以着力,即推动建立知识产权保护转化运营机构,建立知识产权纠纷多元化解平台,明确本次知识产权机构深化改革的重点,建立和完善多元的、综合的知识产权决策议事协调机构,加强地方知识产权保护法规建设和政策引导。
The Third Plenary Session of the Nineteenth Central Committee of the C.P.C has made a comprehensive plan on deepening the reform of party and state institutions.The corresponding theoretical support,policy conditions and practical experience have been matured enough in China.There fore,it must be enforced to deepen the reform of the comprehensive administrative management of intellectual property in Hunan province.In the macro-environment of deepening institutional reform,prominent conflicts still exist between the rising application increment and the low effectiveness of IP right,between the hyper-growth of cases and the cut-down of law enforcement personnel,as well as between more responsibilities and duties.and less personnel and weakened functions.In this regard,efforts can be made from the following five aspects,which are to encourage IP transformation and operating,to establish an ADR platform for IP disputes,grasp the main factor of the ongoing reform,to construct a diversified and comprehensive IP deliberative and coordinating body for decision-making,to improve local IP legislation and policy guidance,and to strengthen the construction of local laws and regulations and policy guidance for IP protection.
