摘要
在世界贸易组织(WTO)陷入多边立法困境的背景下,美欧进行的跨大西洋贸易与投资伙伴关系(TTIP)新一代贸易规则谈判引人关注。本文从双层博弈视角分析了TTIP监管议题谈判的前景,认为谈判虽然面临诸多挑战,但双方在常规性合作机制和已有共识基础上达成监管协议的可能性是存在的。监管议题更大的挑战将出现在美欧各自的议会批准环节,其中以美国的挑战最为突出。在TTIP谈判期限内,奥巴马总统得到国会贸易促进授权的前景不容乐观,即使美欧达成TTIP监管协议,该协议在国会批准环节也充满变数。
Against the background of rule-making dilemma at WTO,the ongoing TTIP negotiation between the U.S.and EU attracts the attention of the world.Any agreement reached within TTIP may have far-reaching impact on international trade law.Regulation is one of the three major areas of TTIP negotiation,covering topics from TBTPLUS,SPS-PLUS to horizontal regulation rules.Focusing on the prospect of TTIP negotiation on regulation,this paper argues that,EU and the U.S.,have reached certain consensus through routine regulatory cooperation.Therefore,it is possible that EU and the U.S.may reach an agreement on regulation issues.However,congress,especially the U.S.congress poses great challenge to any potential agreements.A majority of Democrats,who advocate more power for congress in new-generation-FTA negotiation,are generally against TPA.American people are skeptical toward the outcome of existing FTAs.President Obama is facing great uncertainty in getting TPA,which casts a shadow on the success of TTIP regulatory negotiation.
