摘要
消费者后悔权与经营者无因退货许诺产生于不同的社会经济条件并经过了各自的发展历程。在我国,消费者后悔权入法之前,经营者已有了无因退货许诺实践。消费者后悔权是一项法定的消费者权利,也是一项不同于合同法上撤销权和解除权的形成权,而经营者无因退货许诺则表现为民法上的允诺行为,对消费者也构成债法上的请求权。通过对两项制度的比较分析,以揭示它们在价值目标、行使机制等方面的异同性,从而探讨在《中华人民共和国消费者权益保护法》确认消费者后悔权的背景下,两项制度在融合和差异化发展中如何更好地发挥应有的作用。
The consumers' right to regret and the dealers' promise of unconditional refund were produced under different social and economic contexts and had gone through different development stages.In our country,prior to the consumers' right to regret,the promise of unconditional refund has already been practiced by dealers.To regret is a statutory right for consumers,as well as a right of formation different from the right of revocation and termination in contract law.However,dealers' promise of unconditional refund is manifested as a promise to act in civil law,and constituted a claim on consumer debt.This article attempts to use the comparative analysis of the two systems to compare and contrast aspects like their value goals and the exercise mechanism,so as to discuss how the two systems could play their roles in the integration and differentiation process on the basis that the Consumer Protection Law has confirmed consumers' right to regret.
