资方违法行为确认之诉:工会维权的重要工具——基于案由、诉种特殊性及其功能的分析

摘要 最高法院公布的劳动争议案由的类、种和亚种相对简单,无法容纳实践中大量具有可诉性、可类型化的劳动争议。资方违法行为确认之诉,在案由、诉因和诉种层面具有特殊性和独立性,应成为法定案由体系中的新案由、劳动司法实践中的新诉种。此类确认之诉可单独提起,也可与给付之诉、形成之诉合并提起。该新案由、诉种使相关纠纷得以程序化、机制化、法治化地处理,对于警示、对抗、约束资方违法侵权和遏制权利争议,具有显著功能;对于维权乏术、绩效欠佳、公信力不足的地方工会,具有特别的工具价值。 The categories, types and sub-types of labour disputes promulgated by the Supreme Court are relatively simple, which can completely cover all suable and typifying labour disputes in practice. Litigation of confirmation on illegal actions of the employer holds specialty and independency in the terms of causes for action, suing reasons and category. It should become the new causes for action in the system of legal causes for action, as well as the new category in judiciary on labour cases. It can be raised separately, or being combined with sue for payment and formation. It could be conducive to the labour dispute resolved in a legally procedural mechanism. It also prominently matters to alert, struggle and constrain illegal actions of the employer. The trade union without competency, efficiency and legitimacy in defending workers' rights can also benefit from it.
