摘要
人民陪审制是我国一项重要的司法制度,也彰显着社会主义民主价值。但是,从协商民主视角出发,我国当前的人民陪审制还面临着陪审员队伍精英化趋势明显、"陪而不审、合而不议"现象突出和现有保障机制不健全等问题。处理好人民陪审员遴选方面"代表性"与"专业性"的关系,完善相应的程序性保障机制,健全相应的激励与惩戒机制,这些理应成为我国人民陪审制未来革新的方向。
The people＇s assessor system is an important judicial system in China, demonstrating its socialistdemocratic values. However, the people＇s assessor system is facing some problems from the perspective of delib-erative democracy, such as the tendency to draw the panel of assessors from an educationally privileged pool,the panel of assessors who sit in but do not assess, and imperfect security mechanism. Therefore, the reform ofthe people＇s assessor system should handle the relationship between ＂representative＂ and ＂professional＂ in theselection of people＇s assessors, improve relevant procedural mechanism, and improve security mechanisms con-cerning encouragement and penalty.
