摘要
现代契约的精神来自罗马法,而婚姻本身确实具有契约的外观和某些属性。从法律上看,婚姻可视为平等的异性主体之间就共同生活缔结契约而形成的法律关系。当今我国社会,离婚率不断攀升,且关键问题之一便是财产分割,故婚姻中妇女的财产权益保护已成为值得关注的现实问题。本文从契约婚姻的视角,对婚姻中妇女财产权益的保护进行探讨,通过反思《婚姻法司法解释(三)》的有关规定,提出相应的修改建议与对策,为婚姻关系中妇女财产权益的法律保护提供一种理论上的探索与思考。
the modern spirit of contract from the Rome law, but the marriage itself has the appearance and some properties of contract. From the point of view of law, legal relationship of marriage can be regarded as equal between specific subjects lived together and the formation of the contract. Today in our society, rising divorce rates, and one of the key problems is the division of property, the protection of property rights of married women in has become a real concern. In this paper, from the perspective of contract of marriage, inquires into the protection of the marriage of women＇s property rights, through the reflection on the ＂marriage law judicial interpretation （three） the relevant provisions of the＂, to amend the corresponding suggestions and countermeasures, providing a theoretical exploration and Thinking on the legal protection for women in the marriage property rights.
