摘要
我国开展的众多"扫黄打非"专项工作中,对淫秽物品的管控工作是保障具有淫秽性质的文化垃圾能够被成功清除、社会文化环境能够得到净化的重要一环。但就涉案的淫秽物品的鉴定方面还存在着诸多问题:淫秽物品鉴定的释义与淫秽物品认定的释义相混淆;淫秽物品的鉴定机构与淫秽物品的追溯机关实属同一,影响法律程序与实体正义;公安机关鉴定人员资质问题无法解决;鉴定人员水平无法评测等。只有建立第三方淫秽物品鉴定机构,才能将问题妥善、合理地解决。
In China’s campaigns against pornographic and illegal publications, the management and control of pornographic articles is an important task to ensure that the cultural garbage with pornographic nature can be eliminated successfully, and the social and cultural environment can be purged. However, there still exist many problems in the appraisal of pornographic articles. For example, the appraisal of pornographic articles is likely to be confused with the recognition for pornographic articles, to empower same organs to trace and appraise the pornographic articles will inevitably affect the substantive and procedural justice, and as the appraisers assigned by public security organs have no qualification, it’s hard to evaluate their appraisal levels. Only by establishing a third-party appraisal agency for the pornographic articles can these problems be resolved properly and reasonably.
