摘要
作为法院内设机构改革典型之一的成都市中级人民法院机构改革具有积极意义。深化改革需要协调解决内外矛盾,包括审判体内部的司法性与行政性的矛盾、"大部制"改革与特色业务及综合业务管理的矛盾以及机构体量平衡性的矛盾。同时需解决法官职级待遇及人员的可融通性、较大数量非审判事务应对以及内部改革与外部机构设置要求的冲突等问题。改革需兼顾司法责任制与审判监督管理的需要,区分院、庭责任,适当设置审判监督管理节点,处理好审判庭与审判业务团队的关系。
The reform of interior setup conducted by the Chengdu Intermediary Court,one of the models of such reform,do have positive elements. The paper points out the interior and exterior conflicts to be resolved in the reform of such setup,including conflicts between the judicial trial function and the administrative management function,conflicts between the structuring reform and specialization of trial work,and conflicts between the amount of workload and the institutional scale of a court. Meanwhile,we need to solve such problems as the pay of judges,versatility of judges,excessive non-trial matters,and the conflicts between interior setup reform and exterior institutional structuring.
