摘要
《海峡两岸共同打击犯罪及司法互助协议》原则性规定了两岸调查取证互助问题。"取得证言及陈述"是两岸民事调查取证互助的重要内容。大陆与台湾地区有关证人证言和当事人陈述的民事证据规定及其适用存在差异。两岸都规定了证人的作证义务,台湾地区还规定了证人的拒绝证言权;两岸关于作为证据的陈述的规则都经历了发展完善的过程,且表现出内容的趋同,但在具体适用时的评估标准可能不尽相同。根据司法互助的法律适用机制,两岸相互协助调查取证应主要适用受请求方相关规定,同时在一定条件下,可例外适用请求方相关规定。因而,须对上述司法互助协议中规定的"依己方规定"、"依请求方要求"、"尽力"等作具体分析与解读。
The Cross-Strait Agreement on Combating Crime and Mutual Judicial Assistance stipulates in principle the mutual assistance of investigation and evidence collection.Witness testimony and statements are the main forms of evidence,and "obtaining testimony and statements"is also an important content of the cross-strait mutual assistance of investigation and evidence collection.The civil evidence stipulation and its application on witness testimony and statements of the parties in Mainland is different from that in Taiwan region.The regulations of the cross-strait both regulate the responsibility of witness to testify,the Taiwan region also provides for witnesses's right to reject testimony;the statements rules as evidence on the cross-strait have undergone a process of development and improvement,and show the convergence of con-tent.However,the criteria for evaluation may differ in specific application.According to the application mechanism of mutual assistance,the cross-strait mutual assistance in investigation and evidence collection shall mainly apply to the regulations of the requested party.At the same time,under certain conditions,the regulations of the request party may be applied.Therefore,it is necessary to make concrete analysis and interpretation of "according to its provisions","according to request of the requesting party"etc.
