摘要
国家及其财产豁免 ,有绝对主义和限制主义两种主要理论。我国在实践中赞同绝对主义 ,但这方面的立法尚待完善。
Boththe doctrine of absolut immunity and the doctrine of restrictive immunity are the two theories which express the scope of state and its property immunity from different viewpoints. The former is widely accepted among Chinese judicial practice,but there is still a long way to go for Chinese legislation. [
