摘要
市场监管的正当性源自市场运行存在内生性缺陷及其安全风险并需要外力矫正,在法治理念指导下,市场监管的本质是一种法律监管,而不是权力监管。尽管市场监管法可能含有具有行政法属性的法律规范,但市场监管法的调整对象是市场结构利益关系,这些规范不能改变其秩序性规则的整体性质。
The legitimacy of market regulation originates from the endogenous defects and security risks of market operation and the need for external rectification. Governed by the ideology of the rule of law, the nature of market regulation is a kind of legal regulation, rather than power regulation. Objects adjusted by market regulation law are interest relationships affected by market structure. Although market regulation law may contain legal norms with attributes of administrative law, these norms can not change the holistie nature of market regulation law as a law of rules of order.
