摘要
在《中华人民共和国不动产登记条例(草案)》即将出台的背景下,如何加强《不动产登记条例(草案)》的可操作性、如何保护公民的隐私权以及如何让权力在阳光下运行这三个问题非常值得我们思考。文章通过对美国、德国、日本及我国香港地区的不动产登记信息查询制度进行比较,再结合我国的具体实际情况,提出现如今完全开放不动产登记信息查询并不现实,而是应该在不动产登记信息查询制度中引入律师查询的相关制度,这是因为律师作为法律从业的专业人士,具有专业化和便于行业统一管理的优势。
With the issue of Real Estate Registration Ordinance of People’s Republic of China, how to strengthen its operability, how to protect the priva-cy of citizens and how to ensure authority＆#39;s transparency call for consideration. Based on the comparison in real estate registration information inquiry system among the United States, Germany, Japan and HongKong, and combined with the specific actuality in China, it＆#39;s proposed that it＆#39;s not realistic to fully open real estate registration information inquiry system, and lawyer query system should be introduced into it. Because as professionals, lawyers are equipped with advantages of professionalism and convenient uniform management.
