摘要
互联网的高速发展给各国均带来诸多法律问题,而网络谣言的治理问题首当其冲。美韩政府针对网络谣言的治理进行了很多努力,从民事、行政、刑事等方面全面对网络谣言进行治理,但是美韩两国在网络谣言治理之初分别采取了完全不同的路径:美国政府因自由言论的宪法屏障而退居二线,以社会自主治理为主;韩国政府则主动出击,建立了网络实名制度。两国在十多年的实践中不断探索,以寻求网络谣言治理的平衡点:对谣言既不过度管制,也不过分放任。两国在实践中的经验值得我们很好总结并予以借鉴。
The fast development of internet has brought a great deal of legal problems to many countries, among which is the regu-lation of internet rumors. The U.S. and S. Korean Governments have made many efforts to regulate internet rumors from multiple aspects like civil, administration and criminal legislation. However, the U.S. and S. Korea have taken two separate routes to regulate the internet rumors. The U.S. Government fell back from the leading post because of the constitutional barrier of “freedom of speech” and the self-regulation of the internet society became the main approach;meanwhile the S. Korea Government actively regulate the internet even with the establishment of the “real name verification system”. Both two countries are trying to find a balanced point through the more than ten years practice where the internet rumour is neither over-regulated nor over-indulged. The experience of both countries should be well-considered and used for our own reference.
