摘要
现行民办教育立法的行为规范中,义务性规范远多于授权性规范,"作为"规范远多于"不作为"规范,"应当"规范又远多于"必须"规范。其中,针对政府的义务性规范最少,针对举办者的强制义务性规范最多,针对国家主体的行为规范则均为权义复合性规范。要实现民办教育立法的促进功能,应明确对政府的强制义务性规范,弱化对举办者的不作为规范,强化对学校的授权性规范。
There are more provisions of obligation, action and "should" than those of authorization, inaction and "must" incurrent Private Education Legislation. It imposes the least obligationsto government, while the most ones toprivate education organizers. Besides, all the codes of conduct fornational objects are the compound of rights and obligations. To realize the promoting function of private education legislation, we should clarify the compulsory and obligatory protocoffor government, weaken the inactiveprotocol forprivate education organizers, and strengthen the authorization of school.
