新时期我国弱势群体体育权利保障研究 被引量:10

Study on Sports Right Guarantee of Social Vulnerable Group in Chinese New Era

摘要 采用文献资料等研究方法,从法社会学的视角对弱势群体体育权利进行分析和研究。认为现阶段弱势群体的体育权利还属于"书本上的法"和"应有权利",只有将弱势群体体育权利这种"书本上的法""应有权利"转化为"行动中的法"和"实有权利"才有真正的现实意义。对弱势群体体育权利的真正保障有利于社会主义和谐社会的构建、有利于全民健身计划的全面实施以及弱势群体社会保障体系的健全。弱势群体自身素质、社会排斥以及公共体育资源分配不均衡、社会监管与保障不利是现阶段弱势群体体育权利缺失的主要原因。而要真正实现对我国弱势群体体育权利的保障,培育公民社会,建立弱势群体体育组织、建立弱势群体体育权利支持与服务系统、"以人为本",大力推进体育基本公共服务均等化、提高弱势群体素质、加强对弱势群体体育权利知识的宣传和教育。 Based on literature review and other methods, this paper analyzed sports right of vulnerable group from sociology of law perspective. At present, sports right of vulnerable group was still "law in book" and "deserved right", only it changed to "law in action" and "substantive right" could have realistic meaning. To guarantee sports right of vulnerable group were benefit for constructing harmonious socialist society, implementing nationwide fitness plan and improving vulnerable group social guarantee system. The quality of vulnerable group, social exclusion, the allocation imbalance of public sports resource, lack of social regulation and security were the main reasons for the current situation. The best guarantee ways were to cultivate civil society, to establish social sports organization for vulnerable group, to establish sports rights support and service system for social vulnerable group, and then based on "people oriented" to promote sports equal basic public services, improve quality of vulnerable group, intensify propaganda and education of vulnerable group sports right knowledge.
