摘要
随着患者权利意识的增强及患者权利趋于多元化,医患关系逐渐由医生家长主义模式向患者自主决定模式转变,患者权利冲突日益增多并呈现多面向的图景。这种冲突引发如下之追问:患者权利冲突有什么特点?应当如何进行价值判断与取舍?医学的终极目的是什么?应当依据医疗卫生事业的终极人文价值与伦理原则,实现一般情况下的对患者所有权利的同等保护和特定情况下的对患者某种权利的优先保护,从而实现权利与善的统一。
With the enhancement of patients’ rights awareness and the diversification of patients’ rights ,the doctor-patient relationship is gradually changing from the model of doctor-decision to the model of patient-decision .At the same time ,the conflict of patients’ rights has increased and has multidimensional characteristics .The conflict of patients’ rights brings the following inquiries ：What are the characteristics of the conflict of patients ’ rights ？How to judge and tackle it ？What is the ultimate goal of medicine ？On the basis of the ultimate human values and bioethical principles ,we should try to achieve the equal protection for all rights of patients in the general situations and to achieve prior protection for a certain rights of patients on particular occasion ,so as to realize the unity of rights and goodness .
