摘要
权利限制的功能在于确保权利的实现,因此,为确保权利限制有效发挥这一功能,权利限制也应该有合理的界限。作为一种特殊的权利限制,克减除具有明确的目的性和必要性之外,也应受到合理的限制,其具体表现为:一些基本权利在任何情况下都不能克减。在理论上,不可克减的权利是权利限制得以存在的正当性基础;在制度上,不可克减的权利是克减有效发挥作用的纠偏机制;在价值功能上,不可克减的权利的功能的发挥是克减功能的具体体现和升华。
