摘要
目前,关于中医药传统知识保护客体范围的探讨,各个领域的专家学者研究的专著并不多,也并没有深入的研究。研究大多局限在一部分中医药传统知识上,如对经典方剂、道地药材等客体的保护进行了一定探讨,但也并无深入调研及可操作性的研究报告。因此,文章就中医药传统知识法律保护问题的基础性问题,即中医药传统知识保护的客体进行探讨,主要对中医药传统知识保护客体的内涵及范围进行初步界定。
Currently, the monographers on the connotation and scope of traditional Chinese medical knowledge protection are few and rarely intensive. The subjects are mostly limited to part of traditional medical knowledge, such as classical prescriptions, genuine medicinal materials, etc. Altough some of the researches have moderate discussions on the object, there are few intensive and operable reports available. This thesis will thereby give a detailed discussion on foundamental problems of the traditional Chinese medical knowledge protection, that is, the protective object of traditional Chinese medical knowledge. The discussion will mainly include the connotation of the pretective object and the definition on this sphere.
