摘要
运用文献资料、逻辑分析等研究方法对我国体育品牌侵权进行研究,旨在为保护体育品牌不受侵害提供理论参考。我国体育品牌侵权责任承担的主体、客体、介体和环体、责任评定部门及赔偿等存在不完善之处,需要构建完善的体育合同法律体系来保护体育品牌价值。加强侵权责任认定的规范化建设、增强司法对品牌侵权行为惩戒力度、严厉打击品牌侵权行为、提高企业的品牌意识和消费者的消费理念、增强品牌建设的重视程度、合理引导大众消费等途径,是切实保护体育品牌不受侵害、加强体育品牌建设的可行之路。
By means of literature data, logic analysis and other methods, analysis of infringements on Chinese sports brand was conducted in hope that the protection of sports brand from could be made and theoretical reference be offered. Research conclude that Chinese sports brand tort responsibility main body, object, medium and the ring body, responsibility assess- ment and compensation is imperfect, we thus need to perfect the sports contract legal system to protect the game brand value. It is of a duty to strengthen the infringement liability of standardization construction of brand tort and reinforce the judicial punishment, to crack down on brand tort and to improve enterprise brand awareness and consumption concept. It is of re- sponsibility to strengthen brand construction seriously.
