摘要
学者多认为西汉酷吏群体与秦代的法家文化具有内在关联。然而,具体到西汉河东盛产酷吏的现象,无疑与法家文化在该地区的发展历史与现状有关。从学术史角度看,三晋本是法家思想的策源地,在战国时期,河内、河南分别受到相邻地区的儒、道文化浸染,唯有河东因其独特地理形势,保持了强固的法家文化。从军事角度看,秦汉之交的战乱对河东的影响相对较小,较好地保持了基层社会秩序的连续性,秦王朝政治文化风格的遗留较为沉重。从社会文化角度看,戎狄与相邻的边地文化形态曾是促使法家思想形成的一个重要因素,秦汉时代的河东地区虽是内郡,仍然保留着较强烈的边地气息,这为酷吏群体的产生提供了土壤。
Scholars usually thought that the cruel officials of the Western Han Dynasty and legalists of the Qin Dynasty had intrinsic correlation.However, the phenomenon of the district Hedong rich in cruel officials in the Western Han Dynasty was related to the history and the present situation of legalists in this district.In the sense of academic history, Jin was the birthplace of legalism, in the Warring States period, these two district of Henei and Henan were respectively influenced by the Confucianism and Taoism from adjacent areas, but Hedong maintained a strong legalism because of its enclosed situation. From the military perspective, the war in the end of the Qin Dynasty had a relatively small effect on Hedong, this district better maintained social order and political culture legacy of the Qin Dynasty.From the perspective of social euhure,the condition of being adjacent to the minorities of Rong and Di once was one of the important factors leading to the legalism, in the Qin and Han Dynasties.Although Hedong was an internal district, it still retained the strong frontier customs,and this situation provided the soil for generating cruel officials .
