摘要
改革开放以来,随着我国社会经济的迅猛发展,国内单位的劳动用工方式也随之呈现多样化。根据1986年国务院的"四个规定",20世纪80年代产生了一批"劳动合同制工人",但在该类人员退休待遇问题上,却产生了与普通事业单位编制人员不同的退休待遇,出现了形式正义与实质正义的冲突。解决这一冲突,应考虑以下三个方面:其一,从法律角度理性分析,事业单位"劳动合同制工人"就是普通劳动合同性质的劳动者,受包括现行《劳动法》、《劳动合同法》、《社会保险费征缴暂行条例》等相关劳动法律法规的调整和约束。其二,从事实角度客观分析,事业单位"劳动合同制工人"在职期间享有事业单位正式编制职工的身份,退休前所享受的工资、福利待遇与其他任何正式编制员工是没有任何差别的,唯一的区别就是事业单位依据1986年国务院的"四个规定"精神为该类人员办理并缴纳了社会养老保险。其三,从法的价值角度看,需要具体权衡形式正义与实质正义的关系,最大化平衡协调二者之间的冲突。
Since the establishment of Reform and Opening-up policies, along with fast development of China's society and economy, the labor employment methods have been diversified. On the basis of the four "Regulations" on contract labors by the State Council in 1986, "Labor Contract System Workers" have emerged since 1980s. However, their retiring treatment has been different from that for ordinary organization personnel, which produces a conflict between formal justice and substantial justice. To solve such a conflict, three aspects should be taken into consideration: firstly, analysis from legal aspect shows that "Labor Contract System Workers" in public institutions are workers in the nature of ordinary labor contract, regulated and restrained by relevant labor laws and regulations such as "Labor Law", "Labor Contract Law", and "Provisional Regulations on Levy of Social Insurance Premium"; secondly, analysis from objective facts shows that the identifications of "Labor Contract System Workers" in public institutions work as formal organization personnel, and their wages and benefits are without any difference from formal organization personnel before retirement, the only difference being social old-age insurance paid by the employers against the four " the relation between formal far as possible.
