摘要
伴随我国经济体制的转型,原有计划经济背景下的"举国体制"制度,正在向着职业化、市场化的发展方向转变,这使得当今竞技体育服务产品生产的投资主体与生产主体呈多元化的发展态势,其劳动成果的归属成为各主体间竞争的焦点,并由此引发运动员产权争议与矛盾问题突显。文章从经济学理论视角,借助产权理论和服务产品等理论,对运动员产权的本质属性进行规制,从而明晰竞技体育生产过程中关于劳动成果产权的界定问题,消解主体间因产权归属和利益分配所引发的矛盾冲突,推动我国竞技体育向更高层面发展。
With the transformation of China^s economic system, the original context of the planned econo- my under the ＂whole nation system＂ is changing toward a professional and market-oriented development direction. Under this background, the investment entities and production entities of competitive sports service products exhibit a diversified trend, and the ownership of the products become the competition fo- cus of the different entities, both of which result in the disputes and contradictions about the ownership of the athletes. Therefore, the present thesis sets to define the essential nature of athletes~ property rights based on the property rights theory and the theories of service products, etc. from the perspective of eco- nomic theory, so as to clarify the definition of the property rights in the production process of competitive sports of products, eliminate the conflicts resulting from property rights and interests allocation between subjects, and promote the development of competitive sports in China to a higher level.
