摘要
"信访不信法"是我国从人治向法治转变过程中产生的问题,其产生是由于人治思想的深刻影响和现有权利救济制度的缺陷所导致的。在制度缺陷上表现在两个方面,一则我国现有的法律救济制度不健全,导致法律救济失灵,二则信访制度本身在发展中的功能嬗变错位,导致信访救济功能异化。化解"信访不信法"现象,应当在遵循改革信访制度,矫正信访功能这一基本理念下,从观念上引导公民由人治思想向法治思想的转变,从制度上促进纠纷向法律救济渠道分流。
Belief in letters and visits instead of laws presents when the citizens＇ notion transforms from rule of man to rule of law. It arises out of the rule of man and the defect of right relief system. The defects of right relief system present two aspects： the failure of legal relief because of its imperfection and the right relief function of letters and visits Alienation resulting in the function＇s evolution and dislocation in the development. To resolve the phenomenon of belief in letters and visits instead of laws, we should follow the idea of reforming letters and visits and correcting the functions of letters and visits, then guide citizens to change their notion from rule of man to rule of law, and promote to shunt dispute to the legal relief.
