论“博斯曼法则”与我国运动员股权激励制度的建构

摘要 运用文献资料法、比较与借鉴法,指明“博斯曼法案”对我国职业体育的“土政策”造成了强大冲击,与市场、国际接轨的中国本土版“博斯曼法则”打破了我国职业体育的旧秩序,开启了我国职业运动员自由流动的新纪元。研究发现,在“自由转会时代”,职业俱乐部引入运动员股权激励制度无疑是提高职业运动员积极性、忠诚度与竞技水平的创新尝试;在我国,建构运动员股权激励制度并发挥其在职业体育中的股权激励效应,以期缓解“博斯曼法则”的冲击,并使股权激励制度成为职业俱乐部吸引和留住高水平职业运动员的“金手铐”。 By applying the scientific research methods of literature, comparison and reference, this study reveals the "Bosman Ruling" significantly affected China's domestic policy of professional sports. The domestic "Bosman Rule" which broke the old rules for China's professional sports ushered in a new epoch for the good circulation of professional athletes in China. The practical source of thinking is in freely clubchanging era, applying the equity incentive pol icy will surely be the innovation for improving the enthusiasm, loyalty and athletics level. In order to alleviate the impact of the "Bosman Rule" and make it to be the "golden cuffs" for professional clubs to attract and retain high level professional athletes, the construction of equity incentive policy in China could be one effective solution.
