摘要
高校与大学生之间的法律关系实质是高校与大学生的权利和义务关系,大学生在高校应该享有教育平等权、知情权、参与权、监督权、选择权、就业权等主要权利。但当前高校在管理中却存在重管理轻权利、管理程序不规范、部分高校实行侵权责任保险制度不完善等问题,对此,高校应更新管理理念,强化法治意识,规范管理程序,完善制度建设,落实权利救济,完善侵权责任保险制度,切实维护学生的合法权益。
The legal relationships between universities and undergraduates are essentially their rights and obligations. Undergraduates should enjoy their major rights, i.e. the rights of educational equality, information, participation, supervision, choice and employment, etc. But there are such problems in university management as focusing on management while ignoring the rights of students, nonstandard administrative procedures, some universities＇ imperfect insurance systems for Tort Liability, etc. So, in order to effectively protect students＇ legitimate rights and interests, universities should update their constructive thoughts, strengthen their legal awareness, specify administrative programs, perfect the institutional improvement, complete appeal systems, carry out relief of the students＇ rights, and improve insurance systems for Tort Liability.
