摘要
高等学校与学生之间的法律关系本质上就是权利和义务关系,主要是行政法律关系和民事法律关系。高校学生管理引发的法律纠纷是多方面的,对学生侵权的原因也是多方面的。用法治的理念和精神解决实践中存在的高校学生管理问题,必须坚持以学生为本,充分尊重和保护学生的受教育权和各种合法权益,依法规范高校学生管理的内容和方法,积极推进高校学生管理的民主化、法治化。
The legal relationship between institutions of higher learning and their students is essentially the one between rights and responsibilities, and mainly the one between the administrative laws and civil laws. There are many kinds of legal disputes occur during the coures of the management of students in the institutions, and students＇ rights are offended by different reasons. The legal problems in the management of college students can be resolved from the idea and spirit of laws, which insist on student-center, fully respect and protect students＇ education and other legal rights, and the re.late content and methods in the management of students by laws, and prmote the democratization and Legalization of the management positively.
