摘要
刑法的廉政保障功能指通过制定关于贪污贿赂的刑事法律条文并运用这些法律条文惩治贪污贿赂等犯罪行为,刑法所可能产生的积极作用。刑法的廉政保障功能也有其局限性。其作用机制包括立法和司法两个方面,也需从这两个方面进行功能优化。
The anti-corruption function of Criminal Law mainly refers to the positive effect that Criminal Law may produce by making plans for the embezzlement and bribery crimes and using these laws to punish corruption.The anti-corruption function of Criminal Law also has some limitations.The mechanism of the anti-corruption function of Criminal Law includes two aspects of legislation and judicial.It should also be optimized from the two aspects.
