摘要
刑罚作为抗制犯罪的有效手段和武器,在预防、遏制、惩罚犯罪方面表现出了积极的作用,历来受到人们的重视。然而,刑罚在另一方面,也给社会带来了消极的影响。为了更全面、深刻地认识刑罚的价值,充分、有效地发挥刑罚的正价值,实现刑罚的目的,有必要对刑罚的负价值与非价值进行重点探讨。
Penalty ,as an effective means and weapon against crime, has received great attention for its positive function in preventing and punishing crimes. Whereas on the other hand, penalty exerts negative influence on society. Therefore, study of the negative value and non-value of penalty should be attached importance to for a better and overall understanding of the value of penalty and the implementation of the positive value and the goal of penalty.
